1. Agreement to Terms
HiveMasterPro ("we," "our," or "us") provides a beekeeping management platform for hobbyists, sideliners, and commercial beekeepers in the United States and Canada. By accessing or using our website, signing up for the beta, or using the HiveMasterPro application (web, iOS, Android), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our services.
2. Eligibility
You must be at least 16 years old to use HiveMasterPro. By using our services, you represent that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are using the services on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
3. Description of Service
HiveMasterPro offers cloud-based beekeeping management tools, including:
- Apiary and hive tracking with maps and location data
- Guided inspections, harvest logs, and winter prep
- Varroa monitoring, treatment tracking, and health dashboards
- Queen, split, and swarm tracking
- Pollination contracts and field jobs (Premium: up to 3 contracts / 20 jobs; Commercial: unlimited)
- Basic inventory management (Premium); full inventory suite with POs, lots, and multi-location (Commercial)
- Community features, mentorship, and team collaboration
- AI-assisted insights, inspection parsing, and risk prediction
- Export tools for ELAP, hive count, and compliance reporting
- Integration with sensors (e.g., BroodMinder, HoneyPi, BeeLogger)
We offer a free tier (Community Edition: 2 apiaries, 15 hives) and paid tiers — HiveMasterPro Premium (10 apiaries, 250 hives) and HiveMasterPro Commercial (100 apiaries, 2,500 hives) — with expanded features and higher limits. Enterprise plans with custom limits are available by request. Service availability, features, and limits may change. We host our services on Supabase Pro and Vercel Pro infrastructure.
4. Account Registration and Responsibilities
To use the full application, you must create an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your password and for all activity under your account. You must notify us promptly of any unauthorized access. We may suspend or terminate accounts that violate these Terms or for other reasons we determine in our sole discretion.
5. Acceptable Use
You agree not to:
- Use the services for any illegal purpose or in violation of any applicable law
- Harass, abuse, or harm other users or third parties
- Upload content that infringes intellectual property, privacy, or other rights of others
- Attempt to gain unauthorized access to our systems, other accounts, or third-party services
- Transmit malware, viruses, or other harmful code
- Interfere with or disrupt the service or infrastructure
- Use the services to spam or send unsolicited communications
- Resell, sublicense, or commercially exploit the services without our written permission
We reserve the right to remove content that violates these Terms and to suspend or terminate accounts that engage in prohibited conduct.
6. Subscription and Payment
HiveMasterPro Premium is available by subscription ($12.99/month or $119.99/year) via Stripe Checkout. Commercial is available at $44.99/month or $439.99/year. By subscribing, you agree to Stripe's terms and payment processing. Subscription fees are billed in advance and are non-refundable except as required by law or as we may otherwise agree. We may change pricing with reasonable notice; continued use after a price change constitutes acceptance.
You may cancel your subscription at any time through your account settings or Stripe Customer Portal. Upon cancellation, you will retain access until the end of your current billing period. We do not provide refunds for partial periods. Promo codes and discounts may be subject to additional terms.
7. Intellectual Property
HiveMasterPro, our logos, and the software, design, and content we provide are owned by us or our licensors and are protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the services for your personal or internal business use in accordance with these Terms. You may not copy, modify, distribute, reverse engineer, or create derivative works unless we expressly permit it.
8. Your Content and Data
You retain ownership of the content and data you upload, including apiary records, inspection notes, harvest data, and other user-generated content. By using our services, you grant us a limited license to store, process, display, and transmit your content as necessary to provide, maintain, and improve the services. We do not use your content to train third-party AI models without your explicit consent.
You are responsible for ensuring that your content does not violate any law or third-party rights. We may remove content that we believe violates these Terms or applicable law. You can export your data from the app (e.g., ELAP PDF/CSV, hive count exports, reports) at any time. Our data handling practices are described in our Privacy Policy (available in the footer).
9. Disclaimers
Not Professional Advice. HiveMasterPro is a management tool. It does not provide veterinary, agricultural, legal, or regulatory advice. AI-generated insights, Varroa risk predictions, and other features are for informational purposes only and may not be accurate. Always consult qualified professionals for decisions affecting your business, health, or compliance.
Service "As Is." The services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the services will be uninterrupted, error-free, or secure. We are not responsible for data loss, service interruptions, or third-party failures.
Agriculture & Compliance. You are responsible for complying with applicable laws, including apiary registration, licensing, ELAP, USDA, CFIA, and provincial requirements. We do not guarantee that our export formats or data will meet your specific regulatory needs.
10. Limitation of Liability
To the maximum extent permitted by law, HiveMasterPro and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of or inability to use the services.
Our total liability for any claims arising from or related to these Terms or the services shall not exceed the aggregate amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater. Some jurisdictions do not allow these limitations; in such cases, our liability is limited to the extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless HiveMasterPro and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the services, your content, your violation of these Terms, or your violation of any third-party rights or applicable law.
12. Termination
You may terminate your account at any time. We may suspend or terminate your account or access to the services for violation of these Terms, non-payment, or for any other reason at our discretion.
Upon termination, your right to use the services ceases immediately. We will retain your data for a reasonable period (typically 30 days) to allow you to export it; after that, we may delete it in accordance with our data retention practices. Provisions that by their nature should survive (such as disclaimers, limitation of liability, and indemnification) will survive termination.
13. Modifications
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the services after such changes constitutes acceptance of the modified Terms. If you do not agree, you must stop using the services. We encourage you to review these Terms periodically.
14. Dispute Resolution and Governing Law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the services shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
For EU/EEA consumers, nothing in these Terms affects your statutory rights under applicable consumer protection laws. If you are a consumer in the EU/EEA, you may also bring proceedings in the courts of your country of residence.
15. General
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HiveMasterPro regarding the services. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right does not waive that right. You may not assign these Terms without our consent; we may assign them without restriction.
